New Mexico prosecutors say they will file new charges against Alec Baldwin if further testing shows that his gun was working at the time of the “Rust” shooting.
The special prosecutors in the case, Kari Morrissey and Jason Lewis, dropped manslaughter charges against Baldwin in April.
Baldwin had been accused of negligently pulling the trigger, causing the death of cinematographer Halyna Hutchins. But Baldwin’s lawyers provided analysis that raised doubt that the gun was working properly at the time.

The special prosecutors in the case, Kari Morrissey and Jason Lewis, dropped manslaughter charges against Baldwin in April.
Baldwin had been accused of negligently pulling the trigger, causing the death of cinematographer Halyna Hutchins. But Baldwin’s lawyers provided analysis that raised doubt that the gun was working properly at the time.
The FBI analyzed the gun last year, and broke it during a test firing. In a recent court filing, Morrissey and Lewis said that the gun has been sent to an independent expert for further testing.
“If it is determined that the gun did not malfunction, charges against Mr. Baldwin will proceed,” the prosecutors wrote.

The former armorer for Rust is looking to seize upon dysfunction from New Mexico prosecutors to dismiss involuntary manslaughter charges faulting her for the fatal shooting of the movie’s cinematographer when the revolver Alec Baldwin was holding discharged.
Hannah Gutierrez-Reed argues in a motion filed on Thursday that prosecutors tainted the investigation, didn’t have the authority to bring charges and that her due process rights were violated. She stresses what was described as “improper political motives” of Santa Fe District Attorney Mary Carmack-Altwies and former special prosecutor Andrea Reeb, who was forced to bow out of the case.
The latest setback on the case came in April when involuntary manslaughter charges against Baldwin were dismissed after Jason Lewis and Kari Morrissey were appointed to lead the prosecution. They pointed to “new facts were revealed that demand further investigation and forensic analysis in the case,” and said that charges could be refiled.

Los Angeles, April 21 (Ians) Prosecutors are expected to drop manslaughter charges against Alec Baldwin in the death of ‘Rust’ cinematographer Halyna Hutchins.
In a statement on Thursday evening, the special prosecutors in the case said that new facts had come to light that make it impossible to proceed against Baldwin in the time allotted, reports Variety.

All criminal charges against Alec Baldwin have been dropped, his attorneys say, weeks before the trial over the fatal shooting of Rust cinematographer Halyna Hutchins was set to begin.
Paperwork to dismiss the involuntary manslaughter charges against Baldwin is expected to be filed soon by newly appointed special prosecutors Kari Morrissey and Jason Lewis, per reports.
Law enforcement will continue to investigate how the events of the tragic October 2021 day unfolded, meaning that the case could be reopened in future.

Baldwin and his team submitted his plea in a court filing obtained by The Hollywood Reporter ahead of his first appearance, which was scheduled to take place virtually on Friday but was waived following the filing. Baldwin has repeatedly denied that he was at fault for the shooting.
Baldwin and his team submitted his plea in a court filing obtained by The Hollywood Reporter ahead of his first appearance, which was scheduled to take place virtually on Friday but was waived following the filing. He remains free without having to post bond. Rust armorer Hannah Gutierrez-Reed is still expected to appear on Friday to enter her own plea in the case.
The plea comes less than a week after the Santa Fe County District Attorney downgraded charges against Baldwin and Gutierrez-Reed, removing the firearm enhancement and a potential five-year prison sentence for both. The two still face involuntary manslaughter charges in the case over cinematographer Halyna Hutchins’ death on the Bonanza Creek Ranch set in October 2021, which could result in a maximum of 18 months in prison.

Investigators spent more than a year sorting out blame for the death of Halyna Hutchins, the cinematographer killed on the set of “Rust.” In the end, two agencies came to two sharply different conclusions about Alec Baldwin’s level of responsibility as a producer of the film.
Prosecutors charged Baldwin for firing the gun that killed Hutchins, but also for management failures that created a hazardous set.
“We believe Baldwin, as a producer, knows everything that goes on, on the set,” prosecutor Andrea Reeb said on Fox News’ “The Five” last month. “There were a lot of safety concerns that were brought to the attention of management, and he did nothing about it.”
But in a parallel proceeding, the New Mexico division of the Occupational Safety and Health Administration found that Baldwin was not in charge and was not the one culpable for lax oversight.
