The former New York TV news reporter – one of more than 100 women who say Weinstein sexually harassed or assaulted them during his decades-long career as a top Hollywood gatekeeper – knew the divided decision was a possibility. The judges who issued the ruling had appeared unsettled during an appeals court hearing in February. Still, she needed time to process everything at her home in California.

Los Angeles prosecutors told a judge Tuesday that they will not retry Harvey Weinstein, who was convicted of the rape and sexual assault of one woman, on counts involving two others that left jurors deadlocked.
Deputy District Attorney Paul Thompson announced the decision to Superior Court Judge Lisa B. Lench at a hearing in downtown Los Angeles. The judge granted a defense motion to dismiss the charges and said Weinstein would be returned to New York, where he was convicted in a similar case.
Weinstein attorney Jacqueline Sparagna said he maintains his innocence of the charges.
In December, the Los Angeles jury convicted Weinstein, 70, of the rape and sexual assault of Italian model and actor Evgeniya Chernyshova, and he was sentenced to 16 years in prison. That’s in addition to the 23-year sentence he is already serving in New York.

Harvey Weinstein’s lawyers on Tuesday filed a motion for a new trial in his Los Angeles rape case, saying they have evidence of Facebook messages that would “impeach” the credibility of the witness known as Jane Doe 1 – the Italian model-actress and only woman whose accusations led to his December conviction.
Weinstein’s attorneys sent the motion to Judge Lisa Lench, who oversaw the two-month trial that ended Dec. 19, when the “Pulp Fiction” producer was convicted on three charges of rape and sexual assault. All three charges were related to the witness known as Jane Doe 1, who testified that Weinstein stalked her to her hotel room in 2013 and raped her during the L.A. Italia Film Festival.
Charges stemming from the other witnesses, including Jennifer Siebel Newsom, ended in a hung jury and mistrial on three counts, with one count resulting in acquittal. Weinstein is scheduled to be sentenced on Feb.

Editors Note: In the wake of Harvey Weinstein’s Los Angeles trial for rape, another woman has stepped forward alleging the media mogul sexually assaulted her 22 years ago.
A ballerina and a model, Lisa Pekar moved to Los Angeles from Milwaukee in September 2000 to pursue her Hollywood dreams as a writer and possibly an actress.
Pekar wrote a piece about her experience and also was interviewed for TheWrap by Kelly Hartog. Pekar’s allegations were corroborated by a witness who spoke to TheWrap on condition of anonymity. Asked to respond to these allegations, a spokesperson for Weinstein said: “Harvey… believes that this sequence of events did not happen as suggested here and that the accusation just isn’t true. The fact is that this narrative is so similar to others, it is therefore easy enough to suggest to some that it is a valid recollection, yet it is also possibly being repurposed for other reasons.

Sentencing in the Los Angeles rape trial of Harvey Weinstein was postponed Monday, as defense lawyers were granted a continuance after indicating that they plan seek a new trial.
Judge Lisa Lench granted the request by defense attorney Mark Werksman at the hearing that was set when the disgraced producer was convicted last month on three of seven counts. Lench said she had received the request “to continue for the purpose of filing a new trial motion.”
Lench gave Werksman until Jan. 31 to file for a new trial, and the prosecution will have until Feb. 14 to respond. A new sentencing hearing was then set for Feb. 23, which will go forward unless a new trial is granted.

He was convicted on Dec. 19 of rape and sexual assault charges in Los Angeles, meaning that he will not go free even if his New York conviction is overturned. But for a lot of observers, Weinstein’s second trial sent an ambiguous or even discouraging message.
Weinstein was — and remains — the face of the #MeToo movement. Yet his conviction was no slam dunk for L.A. prosecutors. Instead, the jurors took more than 40 hours to reach a decision, and unanimously believed only one of the four accusers.
“I think the #MeToo movement at one point was much stronger than it is now,” says Sam Dordulian, a former sex crimes prosecutor who is now in private practice. “The whole feeling of the #MeToo movement that if you come out in numbers, you will be believed — that didn’t pan out on this
one.

The Los Angeles jury considering rape and sex assault charges against Harvey Weinstein on Friday completed a full week of deliberations without a verdict – or even so much as a peep.
No questions, no requests to read back testimony, and no indication of how things are going. The panel’s radio silence is not particularly unusual, nor is the amount of time things are taking, given the complexity of the case and the number of witnesses.
But the two things together make it impossible to even speculate about what’s going on back there.
By the time they went home late Friday afternoon, jurors had deliberated for a total of 26 hours over 5½ days, and were due back Monday morning at 9:30 a.m. The only spark of drama so far: An alternate juror asked on Friday to be excused to begin a trip planned for next week, but was denied.
