On Tuesday, August 16th, Breaking Benjamin will release their greatest hits album, “Shallow Bay: The Best of Breaking Benjamin”. The rock band, which consists of lead vocalist and rhythm guitarist, Benjamin Burnley and drummer and percussionist, Chad Szeliga, have released four studio albums, since their formation in the late 90s. The time has come for the duo to compile some of the tracks off of “Saturate”, “We Are Not Alone”, “Phobia” and “Dear Agony” to form one cohesive album that represents their decade long career. Breaking Benjamin, who are currently in hiatus, have broken up. Frontman and founding member Benjamin Burnley fired guitarist Aaron Fincke and bassist Mark Klepaski, and took legal action against them for allegedly remixing the group's song "Blow Me Away" without consent.
The dispute over the song remix erupted in May, and ended up with Burnley firing Fincke and Klepaski via e-mail. In the lawsuit document filed in June, Burnley claimed his two former bandmates signed a deal with Hollywood Records to remix their song without his consent. In compensation, he is seeking $250,000.
Also, Burnley is entitled, under the band's partnership agreement, to retain exclusive ownership of the band's name. However, Fincke and Klepaski counter backed the statement. They argued that the agreement they made in 2009 about Burnley having permission to dismiss them for "cause" had been invalid since the band took hiatus in June 2010 due to his illness.

Alt-metal combo Breaking Benjamin have come up with a cool retro-geek twist to promote their upcoming album Dear Agony – this week they launched an online flash video game based on the Sega classic Altered Beast, replacing the game's monster-battling hero with a 16-bit version of frontman Benjamin Burnley. Find out more about the game and their upcoming release after the jump! In an homage to the Sega Genesis original, Altered Benjamin pits Burnley against hideous hordes of demons, ghouls and other supernatural creatures, with power-ups that transform the character into a super-Benjamin, and play levels climaxing in battles with other members of the band. The music video for Breaking Benjamin's new single "I Will Not Bow" had been made public in August, and now the band streamed a behind-the-scenes look at the making of the video. Nearly four minutes long, the on-set video is posted on the band's MySpace and exposes the shooting of the band rocking out in World Trade Center building 7.
The video also features the band sitting down and addressing issues from "I Will Not Bow" being chosen as a theme song for "Surrogates" to working on their fourth studio album, "Dear Agony", with producer David Bendeth. When talking about "Surrogates", frontman Benjamin Burnley admits that he could make good use of a surrogate.
"I Will Not Bow" is not only picked up as a soundtrack for "Surrogates", but also chosen as the lead single off the band's upcoming fourth studio effort. The album is set to arrive in the U.
