TikTok‘s plan to challenge the new “divest-or-ban” law has encountered a setback. NetChoice, an advocacy group that has supported several of TikTok’s court battles, has removed the platform from its membership rolls after taking heat from Congressional leaders.
Two sources familiar with the situation told Politico that NetChoice kicked out TikTok in response to pressure from House Majority Leader Steve Scalise (R-LA). A third source explained that NetChoice made its decision after learning that the House Select Committee on China plans to investigate firms with ties to TikTok.
A TikTok spokesperson criticized Congress’ “brazen efforts” to “intimidate private organizations for associating with a company with 170 million users.” The spokesperson told Politico characterized Scalise’s tactic as “a clear abuse of power that smacks of McCarthyism.”
No matter the ethics of NetChoice’s decision, its breakup with TikTok does not bode well for the app’s legal defense.

Update: The House of Representatives overwhelmingly rejected Rep. Marjorie Taylor Greene’s effort to oust Speaker Mike Johnson, a move that would have sent the chamber into another round of chaos.
Greene’s motion to oust Johnson was tabled 359-43, with seven members voting present. Eleven Republicans and 32 Democrats voted against sidelining the motion.
The vote was a resounding defeat for Greene, who had insisted that she had substantial support for her effort.
CNN and MSNBC did extensive coverage of the vote, but Fox News largely stuck with The Five, doing a more complete update on Special Report at 6 p.m. Et.
That’s quite a contrast to October, when the House rejected efforts to table a resolution to oust Speaker Kevin McCarthy. He then was removed as speaker, with 208 Democrats joining with eight Republicans.
That led to a protracted effort to find a successor who could amass a majority to become the next speaker.

Congress was flooded with phone calls this week from angry teens opposing a bill that could potentially ban TikTok. President Joe Biden isn’t worried about the controversy. On Friday, he told reporters he plans to sign the legislation if it passes.
The statement comes as Biden’s likely 2024 opponent Donald Trump has started backing away from his past efforts to ban TikTok, and is now publicly defending the popular platform — a decision that some observers speculate could be related to a Republican megadonor’s financial interests in TikTok’s parent company.

Joe Biden said that he would sign a bill that would force ByteDance to divest TikTok or face a ban of the popular app.
“If they pass it, I’ll sign it,” Biden said.
On Thursday, the House Energy and Commerce Committee unanimously passed a bill that would compel ByteDance, the Chinese parent company of TikTok, to sell the social media platform or face having it banned on app stores or web hosting services.
Despite a TikTok effort to rally users to protest the bill to their members of Congress, the legislation appeared to have some momentum later in the day, when House Majority Leader Steve Scalise said that a floor vote would be scheduled for next week.
But the GOP’s presumptive nominee, Donald Trump, warned about the bill. He wrote on his social media platform later on Thursday, “If you get rid of TikTok, Facebook and Zuckerschmuck will double their business.

Update: The House Energy & Commerce Committee unanimously passed legislation to compel ByteDance to divest TikTok or face having the social media platform banned on app stores or web hosting services.
The committee voted 50-o for the legislation, which now must be voted on by the full House. But Speaker Mike Johnson has expressed support for the bill.
The vote followed a lobbying effort by TikTok, including sending prompts to users urging them to contact their member of Congress to protest the legislation.
Lawmakers’ offices reported being inundated with calls, but the strategy may have backfired when it came to members of the committee.
At a markup this afternoon, Rep. Cathy McMorris Rodgers (R-Wa), the chair of the committee, said that “we witnessed first hand, in real time, how the Chinese Communist party can weaponize platforms like TikTok to manipulate the American people.” She accused the company of forcing users...

Homeland Security Secretary Alejandro Mayorkas survived a House Republican effort to impeach him Tuesday.
A motion to impeach Mayorkas, something long sought by GOPers, failed 214-216, with four Republicans joining all Democrats against the motion.
Republicans leaders had sought to impeach Mayorkas over the crisis at the southern U.S. border. But Republicans including Rep. Mike Gallagher (R-Wi), Rep. Tom McClintock (R-ca) and Rep. Ken Buck (R-co) opposed the measure, arguing it would set a precedent for Democrats to try to remove Cabinet members in a Republican administration.
Mayorkas would have been the first Cabinet secretary to be impeached. In 1876, William Belknap, the Secretary of War, resigned before a House vote.

The Senate has finally released its long-discussed, much-debated, bipartisan border package. Despite their demands for many of the increased security measures the bill would provide, House Republicans are setting aside their self-proclaimed commitment to border reform in favor of blocking a potential PR victory for the Biden administration.
Only hours after the 370-page document was released, House Republican leadership was already shutting the doors on its prospects in the lower chamber.

On December 5, House Speaker Mike Johnson delivered a speech at this year’s National Association of Christian Lawmakers gala.
During his speech, he thanked the event’s organizers for not inviting any reporters, though it has not been made clear if he knew that the event’s organizer would record and post a video of the gala on his Facebook page.
“I’ll tell you a secret since the media’s not here,” Johnson told them.
His secret was that he had many conversations with God in the lead-up to the speaker role with which he was anointed.
“The Lord impressed upon my heart a few weeks before this happened that something was going to occur,” he said. “And the Lord very specifically told me in my prayers to prepare but to wait. I had this sense that we were going to come to a Red Sea moment in our...

Jeff Zucker, former head of CNN who now runs media investment fund RedBird Imi, believes the media is overplaying polls showing former President Donald Trump leading Joe Biden.
Appearing at the Yahoo Finance Invest conference in New York, Zucker said it is a “real possibility” that Trump could return to the White House. In preparing for that scenario and covering the yearlong runup to the 2024 election, Zucker said the “key” for news outlets is “not to get caught up” in early poll results. A recent New York Times/Siena College poll showed Biden trailing Trump in five of the six states that helped Biden prevail in 2020.
“That continues to be a huge mistake in the media,” he said. “If you went by the poll in 1983, you would have thought there was no way that Ronald Reagan would win re-election. Or the poll in 2011 — there’s no way Barack Obama could have won re-election.

Mike Johnson is the new Speaker of the House. The Louisiana Republican won the gavel on Wednesday, three chaos-filled weeks after the party ousted Kevin McCarthy from the position earlier this month. Republicans voted unanimously to make him second in line to the presidency.
Johnson, who was elected to the House in 2016, is serving just his fourth term in Congress and is the least experienced Speaker elected to the position since the 1870s. Three other candidates, Reps. Steve Scalise (R-La.), Jim Jordan (R-Ohio), and Tom Emmer (R-Minn.) failed to convert...

Update: Rep. Mike Johnson (R-la) won the vote for speaker, ending three-weeks of Republican intra-party divisions and bitter argument that paralyzed the House.
Johnson won 220 votes while Hakeem Jeffries drew 209 votes. The manual roll call was a contrast to previous ones, as Republicans were unified in their support of the Louisiana Republican, who is little known on the national stage. Yet late on Tuesday, he managed to win a GOP closed-door vote to win the nomination, with members quickly predicting that they would finally coalesce around a speaker candidate.
“The challenge is great, but the time for action is now, and I will not let you down,” Johnson told members after taking the gavel. He said that the first bill he will bring to the floor will be a resolution in support of Israel. He also said that he planned to create a bipartisan commission on the national debt, and...

Update: Rep. Mike Johnson (R-LA) is the latest GOP nominee for speaker, but he may face the same types of divisions that sank three previous party designees for the top House post.
Johnson, the vice chair of the House Republican Conference and deputy whip, drew 128 votes in the third ballot this evening, per CNN, but coming in second, with 44 votes, was “other.” GOP members cast 43 of those “other” votes for Rep. Kevin McCarthy (R-ca), the former speaker, even though he was not in the race. Rep. Byron Donalds (R-fl), the other declared candidate, garnered 29 votes.
“Democracy is messy sometimes, but it is our system,” Johnson said to reporters after the vote. “This conference, this House Republican majority is united.” He said the “intention” is go to the House floor for a vote on Wednesday.

Jordan fell short in roll call votes this week, and lost even more ground in a third ballot Friday.

Members are leaving for the weekend. Rep. Patrick McHenry (R-Nc), who is serving as speaker pro tem, said there will be a candidate forum Monday night and conference elections to select a nominee on Tuesday morning.

Bret Baier’s recent Fox News interview with Saudi Crown Prince Mohammed bin Salman took up less than 36 minutes on the cable outlet’s “Special Report.” Behind the scenes, preparations took months.
Baier spent time in the U.S. with Princess Reema, Saudi Arabia’s ambassador to the United States, and made a special trip overseas to meet with various ministers and the head of state himself to test their rapport. “I went over on a flier,” says Baier during an interview in Fox News Channel’s New York offices. “I said there was not going to be any laying out of what the questions are, that it was going to be tough but fair. And we came to the end, and he said, ‘I think I’m going to do it.’ It took a few months after that to get it locked down.”
What Baier got was something of a surprise.

Update, 1:51 p.m. Pt: Rep. Jim Jordan (R-oh) won the GOP nomination to become the next House Speaker, but he still appeared to be a ways away from securing a majority.
Jordan got 124 votes in secret balloting this afternoon, to 81 for Rep. Austin Scott (R-Ga), according to Punchbowl News and other outlets. Scott got into the race at the last minute earlier today.
Jordan needs 217 votes to win the speakership, although that threshold may change if lawmakers are absent. Jordan requested another secret ballot to see if members would back him in a public vote on the floor of the House, but the vote was 152-55, still far short.
“He’ll get there,” former House Speaker Kevin McCarthy, who was ousted last week, told CNN’s Manu Raju as he exited the GOP conference meeting.
McCarthy said that Jordan has to “just sit down and talk” to the holdouts.

FCC Chairwoman Jessica Rosenworcel is floating a proposal that would require rebates to multichannel subscribers in the event of a blackout or broadcast stations.
Her proposal comes after the recent high-profile standoff between The Walt Disney Co. and Charter Communications, which left ABC-owned stations, ESPN and other cable networks dark for about a week and a half on Spectrum cable systems.
If adopted by the five-member commission, the proposal would then go to public comment period before a final vote. Stephen Colbert has a good idea of what went on during the “therapy session” that took place between roughly 150 lawmakers earlier this week.
The closed-doors meeting took place Monday, two days before the planned vote. Multiple GOP lawmakers described the meeting as “mostly civil, yet cathartic,” according to Politico. However, the meeting ended with House Republicans no closer to agreeing on who should replace Kevin McCarty as Speaker of the House after his recent ousting.
Colbert seized on one member’s description of the meeting as a “therapy session.” “I would hate to be a therapist for the House Republicans,” the late night host said before pretending to be be a medical professional for the party. “‘Normally I don’t say this to a patient, but you are all responsible for your parents’ divorce. All of you. The way you were as a child is why they weren’t happy.

The hosts of “The View” were pretty pleased with President Biden on Wednesday morning, after he unequivocally condemned the terrorist attacks by Hamas in Israel. The women were decidedly less impressed with Rep. Matt Gaetz, with Alyssa Farah Griffin calling him out for “holding congress hostage.”
Discussing Biden’s statement on the attacks, in which he noted that Hamas “brings to mind the worst the worst rampages of Isis,” Farah Griffin applauded the president, saying she had “no notes.” But, she remained frustrated by the fact that the US can only provide limited aid to Israel at the moment, because the House Speaker position is currently vacant.
“This underscores the unseriousness of the Gaetz Eight,” Farah Griffin said, referring to Gaetz and the seven conservatives who led the ouster of Kevin McCarthy, and have a list of demands for the next speaker.

War has erupted between Israel and Hamas, another government shutdown battle looms in the not-so-distant future, and the House of Representatives remains paralyzed by Republican infighting over the speakership.
A closed-door GOP meeting on Monday to discuss the party’s strategy for electing a new leader devolved into a grievance-laden “therapy session” over last week’s vote to remove Kevin McCarthy (R-Calif.) as speaker, according to a report from Politico.

As congress continues to search for a replacement House Speaker, two frontrunners emerged last week, in the form of Rep. Jim Jordan and Rep. Steve Scalise. Both options were pretty bleak for John Oliver, especially considering the latter candidate has previously likened himself to the former leader of the Ku Klux Klan.
To kick off his second episode of “Last Week Tonight,” Oliver immediately got into Kevin McCarthy’s ouster, first poking fun at Patrick McHenry, who is filling the role in the interim.
Oliver joked that he looks like “Patton Oswalt as a ventriloquist dummy” and, like most of the late night hosts did this week, had a laugh at how hard McHenry slammed the gavel to adjourn the House after McCarthy was booted. The late night host then turned his attention to Jordan and Scalise, pointing out that Scalise was once equated to “David Duke without the baggage.

Rep. Nancy Mace announced she plans to support Rep. Jim Jordan to replace ousted House speaker Kevin McCarthy, whom she voted to remove from office last week. When pressed about the allegations that Jordan ignored sexual assaults by a team doctor while he was a wrestling coach at Ohio State University, the Republican congresswoman claimed to not “know anything” about the issue, despite it being widely reported.
“I know you’ve been outspoken about defending victims of sexual assault,” Face the Nation host Margaret Brennan said to Mace on Sunday.

Don’t worry. Although Congress is at a standstill without a speaker for the first time in American history, Rep. Matt Gaetz said that everything is going according to his “plan.”
During an appearance on Meet the Press, Gaetz — who led the effort to oust Rep. Kevin McCarthy from his position as speaker of the House — defended his actions, even though they have left Congress “paralyzed,” according to Democratic Rep. Seth Moulton, in the face of an unprecedented attack against Israel.

Former Democratic presidential nominee Hillary Clinton blasted supporters of former President Donald Trump, particularly in the wake of the January 6, 2021, attack on the Capitol.
“Maybe there needs to be a formal deprogramming of the cult members… and sadly, so many of those extremists, those Maga extremists, take their marching orders from Donald Trump, who has no credibility left by any measure,” she told CNN. “He’s only in it for himself.”
While Clinton predicts that Trump will likely be the 2024 GOP presidential nominee, she believes Joe Biden will be able to beat him a second time.
In an interview with CNN’s Christiane Amanpour, Clinton said, “One will wreck our democracy. One violates the law on a regular basis. One appeals to the worst in our collective psyche. The other gets things done… Why is that a hard choice?”
She also commented on the current Republican leadership race in the House of Representatives,...

A contingent of Republicans is attempting to raise the threshold of support needed within the GOP caucus before a candidate’s nomination as House Speaker can be brought to a floor vote.
Following Tuesday’s ouster of Speaker Kevin McCarthy, led by Rep. Matt Gaetz (R-Fla.) and a small cohort of allies, Republicans are seeking to avoid another public display of GOP disunity. On Friday, 12 GOP representatives officially called for a meeting to consider “an amendment to House Republican Conference Rules to temporarily raise the threshold needed to elect a Speaker.

Donald Trump has declared that if needed, he would consider serving as Speaker of the House for a “short period of time” as Republicans work to elect a new House Speaker to replace Kevin McCarthy, who was ousted Tuesday.
Multiple outlets previously reported the former president was mulling a trip to the Capitol ahead of a vote, amid calls from loyalists within the lower chamber. A source familiar with Trump’s recent private discussions told Rolling Stone that Trump has said that he’s open to the possibility of a speakership run.

Donald Trump is considering making a trip to the Capitol amid calls from loyalists within the lower chamber for him to assume the position of House Speaker. Such a visit would be the first time the former president has visited the building since a mob of his supporters breached it in a violent riot on Jan. 6, 2021.
Multiple outlets reported on Thursday that the former president is mulling a trip next week ahead of a vote, with Politico noting that he is open to pitching himself as a candidate, citing a Republican familiar with internal discussions.

“Morning Joe” host Joe Scarborough was outraged on Friday morning, this time by the response from some Republicans to Donald Trump’s second indictment. According to the MSNBC host, those responses are nothing but “sleazy” sentiments that demonstrate an “absolute contempt for the United States of America.”
The second indictment officially came down on Thursday, as part of Jack Smith’s ongoing investigation into the mishandling of classified documents that were eventually seized from Mar-a-Lago. It’s unknown exactly what charges Trump faces next, but Scarborough noted on Friday morning that he believes Trump will have to plea out to avoid jail time.
Of course, some prominent Republicans — from House Speaker Kevin McCarthy to Steve Scalise to Elise Stefanik — have thrown their support behind the twice-impeached former president once again, instead attacking Biden and saying that he has “weaponized” his Department of Justice to attack his own political opponents.

Rep. Marjorie Taylor Greene (R-Ga.) felt the taunts of irony on Wednesday while temporarily presiding over a House session. The Georgia representative called for decorum in the chamber and was greeted by bursts of laughter from her Democratic colleagues.
“Members are reminded to abide by decorum of the House,” she said in an attempt to quiet down assembled members during a floor speech by House Majority Leader Steve Scalise (R-La.). Instead, the room erupted in boisterous laughter, prompting Green to repeatedly bang her gavel, not that it helped much.

Donald Trump was indicted by a Manhattan grand jury on Thursday. As expected, the former president and his allies reacted with undiluted ire.

House Republicans are preparing to remove Rep. Ilhan Omar (D-Minn.) from the Foreign Affairs Committee, with a vote coming as soon as Wednesday. Why? It could be because they just don’t really like her — for some reason! — or perhaps it’s because they want to get back at Democrats for removing Reps. Marjorie Taylor Greene (R-Ga.) and Paul Gosar (R-Ariz.) from their committees for suggesting violence against their political opponents.

Update: After five roll call votes and no speaker. the House is adjourning for the night.
When they return, many members will be marking the second anniversary of the attack on the Capitol.
Previously: As expected, Kevin McCarthy fell short on the 11th ballot for speaker of the House.
While there are reports of an imminent deal with at least some of the dissidents, an agreement doesn’t appear to be finalized as McCarthy’s allies plan to seek an adjournment until noon Et/9 Am Pt on Friday.
On the floor, Democrats have been in a large huddle around Hakeem Jeffries and other leaders.
Jeffries received 212 votes in the most recent roll call, McCarthy received 200, Byron Donalds garnered 12, Kevin Hern got 7 and Donald Trump got one. There were some guffaws when the clerk read Trump’s vote total.

Update: The House will adjourn until noon Et/9 a.m. Pt on Thursday, giving Kevin McCarthy more time to try to sway holdouts to support his bid for speaker — or work out some other sort of deal.
The scene on the House floor was raucous as Democrats objected to the motion to adjourn, forcing a vote on the issue. They sought to stay in session for the evening, something that would have likely meant another embarrassing roll call vote and defeat for McCarthy. And Democrats nearly got their wish. With the tally neck and neck, Democrats at one point rushed one member through the aisles to cast her ballot before the House clerk called a close to the process. But some Republicans switched their votes to adjourn, eventually giving them a 216-214 majority in favor of adjournment.

When Rep. Steve Scalise (R. As Nancy Pelosi’s husband Paul continues to recover in the hospital after being attacked in his home on Friday, “The View” host Whoopi Goldberg is putting some of the blame for the incident squarely on Fox News. On Tuesday’s episode of the morning talk show, she called them out directly.
The attack led the day’s Hot Topics discussion, with the hosts mourning the increase in political violence, while simultaneously venting their anger over it. In posing the discussion to her co-hosts, Golberg wondered “what else needs to happen” for Republican politicians to condemn the actions of extreme right-wingers.
But eventually, Goldberg offered her own thoughts on who was to blame for the attack at the Pelosi household, at least in part.
