Dominion Voting Systems’ defamation lawsuit against right-wing news outlet Newsmax will get its day in court this fall — right before the 2024 voting begins.
A Delaware judge scheduled the $1.6 billion suit to go to trial in late September 2024, CNN reported. Dominion sued Newsmax, One America News (Oan) and former Overstock CEO Patrick Byrne for defamation in August 2021 over its coverage of the 2020 election.

In talking to reporters afterward, attorneys for Dominion suggested that the whopping settlement sum and the proceedings up to this point held the network accountable for amplifying false allegations that the election software company was involved in rigging the 2020 election in Joe Biden’s favor.

Update, 12:39 Pm Et: The judge presiding over Dominion’s defamation case against Fox pushed back on the network’s attorneys for their argument that Rupert Murdoch would be unable to testify live in the upcoming trial.
In a hearing on Tuesday, Delaware Superior Court Judge Eric Davis cited a letter he received from the Fox legal team arguing that “under Covid, he couldn’t travel, that he doesn’t have knowledge, that it can be difficult for him to come down.”

Fox News cut ties with Abby Grossberg Friday, Variety has learned, citing disclosure of privileged corporate information, after the booker and producer for such hosts as Tucker Carlson and Maria Bartiromo alleged in court filings earlier this week that she was coerced by executives into providing misleading testimony in the $1.6 billion defamation suit that Dominion Voting Systems has levied against the Fox Corp.-backed outlet.
Grossberg, who had worked as a senior booking producer for Bartiromo and head of booking for Carlson, alleged in filings in Delaware Superior Court and the U.S. District Court for the Southern District of New York that Fox attorneys worked to “coach, manipulate, and coerce Ms. Grossberg to deliver shaded and/or incomplete answers during her sworn deposition testimony, which answers were clearly to her reputational detriment but greatly benefitted Fox News,” according to her Delaware lawsuit.

During the past two days, attorneys for both sides have asked Judge Eric Davis to rule in their favor on motions for summary judgment, potentially forestalling a trial that is set to begin April 17.

Fox News is citing newly found emails from Maria Bartiromo’s personal account that they intend to use in their defense of Dominion Voting Systems’ defamation lawsuit.
In one email exchange, Tony Fratto, who in November, 2020 was acting as a spokesman for Dominion, wrote to Bartiromo after watching an interview with Sidney Powell, the attorney and Fox News guest who had been one of the most visible figures pushing the conspiracy theory that the voting systems company rigged the election.
“I just watched the whole interview with Sidney Powell. It’s sad,” Fratto wrote to Bartiromo on Nov. 21.
Bartiromo responded, “Tony. She is pushing on this. Do you want to have dominion ceo on?”
Fratto did not respond to the offer, but wrote, “She is pushing a lot of things and trime [sic] after time they’re proving to be untrue. WSJ editorial board has it right — again today on Georgia handcount.

A Delaware judge declined to toss out a $1.6 billion defamation lawsuit against Fox News filed by Dominion Voting Systems, which claims that the network “sold a false story of election fraud” in the aftermath of the 2020 presidential race.
The ruling on Fox News’ motion to dismiss means that Dominion’s litigation can proceed.
Judge Eric Davis wrote in his opinion (read it here) that Dominion’s lawsuit “alleges facts that Fox made the challenged statements with knowledge of their falsity or with reckless disregard of their truth.”
He added, “The Complaint also alleges facts that there were signs indicating the reports were false. From these, the Court can infer that Fox intended to avoid the truth. Whether Dominion ultimately will prove Fox’s actual malice by clear and convincing evidence is irrelevant on a motion to dismiss. At this stage, it is reasonably conceivable that Dominion has a claim for defamation per se.

ESPN’s “E60” will take a look at baseball great Barry Bonds as he approaches his last year of eligibility on the writers’ ballot for candidates for the Baseball Hall of Fame, a sign that allegations around his use of performance-enhancing drugs have tarnished some parts of his legacy.
The ESPN program will present “Bonds” on Nov. 7 at 9:30 p.m. Et, with Jeremy Schaap reporting. Over the course of his 22-season career, Bonds amassed a record 762 career home runs, a record 73 home runs in a single season and eight Gold Gloves. But, he was indicted in 2007 on charges of perjury and obstruction of justice during the federal government’s investigation into a steroid manufacturer. The perjury charge was dropped and an obstruction conviction was later overturned. Even so, Bonds has not played baseball for a professional team since 2007.
