This is not true, while most defendants charged with murder are remanded, some are granted bail, especially if the charge is murder in the second degree; defendants charged with a capital crime (murder in the first degree and aggravated murder) are always remanded. A judge can consider remand for any class A-I felony, besides murder that also includes aggravated enterprise corruption, arson in the first degree, attempted murder in the first degree, attempted aggravated murder, conspiracy in the first degree, criminal possession of a controlled substance in the first degree, criminal sale of a controlled substance in the first degree, criminal possession of a biological or chemical weapon in the first degree and kidnapping in the first degree.
