The Strikes Will Slow Down the Toronto and Venice Markets, but Buyers and Sellers Are Staying Hungry
“This was the year we were supposed to be going back to movie theaters.” So said producer Marty Katz during a recent interview with IndieWire in advance of the start of the fall festival season. And yet, for the third year in a row, there’s something else keeping things from being business as usual.
That, of course, is the dual strike, which means that dozens of movies premiering at the upcoming fall festivals — including Toronto, Venice, or Telluride — will be without stars on the red carpet or doing the usual promotional push. And while that strike rule is designed to hurt the studios looking to launch their awards titles for the year — and remind them of the necessity of stars to promote their films — smaller projects on the market without a home will inevitably take a hit too.

An official biopic of Roy Orbison has been confirmed...
Roy Orbison’s estate will cooperate with The Big O, a new biopic based on the life of the man who wrote 'Pretty Woman', 'Running Scared', 'In Dreams' and 'Only the Lonely'.
Roy Orbison was made for movies. That pallor. Those sunglasses. David Lynch saw it and Dennis Hopper channeled it. Roy Orbison was a mystery man, who never showed his eyes after losing his wife Claudette, who haunted his songs. Actually, Roy lost his regular, Buddy Holly style glasses on a tour bus with the Beatles when they opened for him in the UK. He kept both the shades and his friendship with George Harrison. They even formed a band together with Bob Dylan, Tom Petty and Jeff Lynne.

Updated: Judge Howard A. Matz has found in favor of defendant Dick Clark Productions in the trial with the Hollywood Foreign Press Association over who owns TV rights to the Golden Globes. Dcp now can continue to produce the Globes, which are organized by the HFPA. In Matz’s 89-page ruling announced today (read it here), he affirmed a 1993 perpetuity amendment that the production company says gave it the right to make a 2010 deal with NBC that will keep the annual awards show on the network until 2018. The HFPA had contended that dcp, which is owned by Red Zone Capital, did not have that right and all its options on the show had expired. “We are extremely pleased with the results,” dcp lawyer Marty Katz told Deadline this afternoon. “It is entirely consistent with the evidence and our witnesses and shows Judge Matz took both into deep consideration.” Said the...

Golden Globes Closing Arguments: Lawyer Says Dick Clark “Enslaved” HFPA Freelance journalist Dominic Patten is covering the trial for Deadline. “They stole the rights!” declared Hollywood Foreign Press Association lawyer Daniel Petrocelli in summing up Dick Clark Productions in his closing argument today. “The servant has become the master.” His courtroom audience included a crowd of past, present and probably future HFPA Presidents, as well as executives from Dcp and its owner Red Zone Capitol, “because of 12 words slipped into a contract that nobody read.” Petrocelli said “our rights are being held hostage” by the the 1993 perpetuity amendment that is the focus of the case. Petrocelli said the HFPA “has a right” to get out of its relationship with Dcp, “a company they certainly don’t trust.” Trust was also a topic raised by Dcp lawyer Marty Katz early this afternon duringduring the early afternoon in his own closing remarks.

Freelance journalist Dominic Patten is covering the trial for Deadline. Update, 1:05 Pm: Closing arguments have concluded and now it’s up to the judge to decide who wins and loses. But don’t expect a decision anytime soon as Matz told the jam-packed courtroom at the end of session today that “it is going to be some time before I can turn back to this”. Previous, 12 Pm: Hollywood Foreign Press Association lawyer Dan Petrocelli said that Dick Clark Productions’ amendment to an agreement about TV rights to the Golden Globes “enslaved the HFPA”. The words came during closing arguments today in the trial between Dcp and the HFPA over those TV rights. Citing a 1993 perpetuity amendment at the heart of the two-week trial, Petrocelli said that “12 words changed the entire course of history between the two parties.” Dcp, said the lawyer, added the language in 1993 in a “sloppy” and...

Freelance journalist Dominic Patten is covering the trial for Deadline. Former HFPA president Dagmar Dunlevy testified in court today she couldn’t recall that any minutes of meetings or tape recordings were destroyed when she was in executive positions at the Golden Globes organization. That contradicts testimony from earlier in the trial from HFPA managing director Chantal Dinnage and former HFPA president Mirjana Van Blaricom, who testified Friday that key minutes from meetings about a 1993 perpetuity agreement at the heart of the case were “missing”. Dunlevy, who took the stand in the late morning of Day 9 of the trial between the HFPA and Dick Clark Productions over who owns the TV rights to the Golden Globes, told Dcp lawyer Marty Katz that she never authorized or knew of destroyed tape recordings or minutes of HFPA meetings involving either the board of directors or the general membership. “I think you are putting too much importance,...

Freelance journalist Dominic Patten is covering the trial for Deadline. Update, 1:50 Pm: Mirjana Van Blaricom testified that “something is missing” from transcripts of the pivotal HFPA membership meeting at which a disputed perpetuity amendment was presented by Golden Globes producer Dick Clark Productions. The HFPA’s president at the time insisted Friday afternoon on the stand that despite a lack of documentation, the organization’s members on September 22, 1993 had a half-hour discussion about the amendment and the longevity of the deal with Dcp after Dcp executives had left the presentation. ”We had discussions,” Van Blaricom testified in a heated exchange with HFPA lawyer Dan Petrocelli, that “as long as Dick Clark keeps us on NBC, he had rights to Golden Globes. Members knew exactly that was the deal.” Von Blaricom left the HFPA in the mid-1990s amid questions about her leadership. Her testimony as a witness for Dcp...

Fresh from its victory over Disney's ABC network, Celador sets sights on firm that set up Us deal for Millionaire
The London-based television production company Celador, which created the game show Who Wants to be a Millionaire?, is considering suing the powerful Hollywood talent agency William Morris for acting improperly in negotiating a deal that brought the hit format onto Us screens in 1999.
Celador is flush from victory after winning $269m (£178m) in damages last week from Disney's ABC network, which airs the Us version of Millionaire. After a six-year legal battle, Celador successfully persuaded a Californian jury that it was fiddled out of a fair share of profits from the show, which is still re-run five days a week on coast-to-coast television.
An original sale of the game show format to Disney was negotiated 11 years ago on Celador's behalf by William Morris, a huge talent empire which represents clients...

Opening arguments were under way Wednesday in the $270 million case brought against Disney and its partners by Celador International, the creators of "Who Wants to Be a Millionaire,” who claim they lost money to an unfair accounting maze.
But arguing for the defense before a nine-person jury, Marty Katz insisted it’s hard to make money in television – even with a hit show. “Who Wants to Be a Millionaire,” he said, despite its huge initial success, was “not a winner” after slicing up expenses and costs.
